400;\">)\u4ee5\u5916)\u3002<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u5c3d\u7ba1\u65b0\u5236\u5ea6\u5df2\u751f\u6548\uff0c\u67d0\u4e9b\u5185\u5730\u5224\u51b3\u4ecd\u9700\u6839\u636e\u65e7\u5236\u5ea6\u7533\u8bf7\u5728\u9999\u6e2f\u767b\u8bb0\u3002\u5c31\u6267\u884c\u800c\u8a00\uff0c\u5df2\u767b\u8bb0\u7684\u5185\u5730\u5224\u51b3\u5177\u6709\u72b9\u5982\u9999\u6e2f\u6cd5\u5ead\u4f5c\u51fa\u7684\u5224\u51b3\u76f8\u540c\u7684\u6548\u529b\u53ca\u6548\u679c\u3002\u7ecf\u767b\u8bb0\u540e\uff0c\u5224\u51b3\u503a\u6743\u4eba\u4fbf\u53ef\u5728\u9999\u6e2f\u6267\u884c\u8be5\u5185\u5730\u5224\u51b3\u3002<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u5e76\u975e\u6240\u6709\u5185\u5730\u5224\u51b3\u90fd\u80fd\u591f\u6839\u636e\u65b0\u3001\u65e7\u5236\u5ea6\u83b7\u9999\u6e2f\u6cd5\u9662\u6279\u51c6\u5728\u9999\u6e2f\u767b\u8bb0\u3002\u5728\u65e7\u5236\u5ea6\u4e0b\uff0c\u53ef\u767b\u8bb0\u7684\u5185\u5730\u5224\u51b3\u5fc5\u987b\u5c5e\u6c11\u5546\u4e8b\u6027\u8d28\u53ca\u81f3\u5c11\u9700\u7b26\u5408\u4ee5\u4e0b\u8981\u6c42\uff1a\uff08a\uff09\u5224\u51b3\u5c5e\u6307\u5b9a\u5185\u5730\u6cd5\u9662\u7684\u9009\u7528\u6cd5\u9662\u4f5c\u51fa;\uff08b\uff09\u5224\u51b3\u7684\u6807\u7684\u534f\u8bae\u5b58\u5728\u6709\u6548\u7684<\/span><i><span style=\"font-weight: 400;\">\u9009\u7528\u5185\u5730\u6cd5\u9662\u534f\u8bae<\/span><\/i><span style=\"font-weight: 400;\">;\uff08c\uff09\u5224\u51b3\u5bf9\u5224\u51b3\u5404\u65b9\u800c\u8a00\u662f\u6700\u7ec8\u53ca\u4e0d\u53ef\u63a8\u7ffb\u7684\u5224\u51b3;\uff08d\uff09\u5224\u51b3\u53ef\u4ee5\u5728\u5185\u5730\u6267\u884c; \u53ca\uff08e\uff09\u5224\u51b3\u996c\u4ee4\u7f34\u4ed8\u4e00\u7b14\u6b3e\u9879\uff08\u8be5\u7b14\u6b3e\u9879\u9700\u4e3a\u65e2\u975e\u987b\u5c31\u7a0e\u6b3e\u6216\u7c7b\u4f3c\u6027\u8d28\u7684\u5176\u4ed6\u6536\u8d39\u800c\u7f34\u4ed8\uff0c\u4ea6\u975e\u987b\u5c31\u7f5a\u6b3e\u6216\u5176\u4ed6\u7f5a\u5219\u800c\u7f34\u4ed8\u7684\uff09\u3002<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u5c3d\u7ba1\u65b0\u3001\u65e7\u5236\u5ea6\u7684\u5b9e\u65bd\u4e3a\u8de8\u5883\u5224\u51b3\u6267\u884c\u63d0\u4f9b\u4e86\u6cd5\u5f8b\u6846\u67b6\uff0c\u8fd1\u671f\u7684<\/span><i><span style=\"font-weight: 400;\">\u4e2d\u56fd\u6c11\u751f\u4fe1\u6258\u6709\u9650\u516c\u53f8v \u5085\u519b<\/span><\/i><span style=\"font-weight: 400;\">\uff08[2025] HKCA 462\uff09\u4e00\u6848\u4e2d\uff0c\u5374\u7a81\u663e\u4e86\u65e7\u5236\u5ea6\u7684\u5c40\u9650\u6027\u3002 \u56e0\u5185\u5730\u3001\u9999\u6e2f\u53f8\u6cd5\u5236\u5ea6\u5404\u81ea\u5b58\u5728\u72ec\u7279\u6027\uff0c\u67d0\u4e9b\u7c7b\u578b\u7684\u5185\u5730\u5224\u51b3\u4ecd\u65e0\u6cd5\u6839\u636e\u65e7\u5236\u5ea6\u5728\u9999\u6e2f\u767b\u8bb0\u3002<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span 400;\">\u6839\u636e\u8d37\u6b3e\u534f\u8bae\u53ca\u62c5\u4fdd\u534f\u8bae\uff0c\u539f\u544a\u4eba\u3001\u501f\u6b3e\u4eba\u53ca\u88ab\u544a\u4eba\u5404\u81ea\u786e\u8ba4\u5411\u5317\u4eac\u5e02\u957f\u5b89\u516c\u8bc1\u5904\u7533\u8bf7\u5bf9\u5408\u540c\u529e\u7406\u5f3a\u5236\u6267\u884c\u516c\u8bc1\u3002 \u82e5\u88ab\u544a\u4eba\u4e0d\u5c65\u884c\u4e49\u52a1\uff0c\u539f\u544a\u4eba\u53ef\u76f4\u63a5\u5411\u6709\u7ba1\u8f96\u6743\u7684\u4eba\u6c11\u6cd5\u9662\u7533\u8bf7\u5f3a\u5236\u6267\u884c\uff0c\u65e0\u9700\u7ecf\u8fc7\u8bc9\u8bbc\u7a0b\u5e8f\uff1b\u800c\u88ab\u544a\u4eba\u5c06\u81ea\u613f\u63a5\u53d7\u5f3a\u5236\u6267\u884c\uff0c\u65e0\u9700\u7ecf\u8fc7\u8bc9\u8bbc\u7a0b\u5e8f\u3002<\/span><\/p>\n<p><span 2020\u5e7412\u67081\u65e5\u4f5c\u51fa\u88c1\u5b9a\uff0c\u786e\u8ba4\u88ab\u6267\u884c\u4eba\u65e0\u53ef\u4f9b\u6267\u884c\u8d22\u4ea7\uff0c\u786e\u8ba4\u88ab\u6267\u884c\u4eba\u8d1f\u6709\u7ee7\u7eed\u5411\u7533\u8bf7\u6267\u884c\u4eba\u5c65\u884c\u503a\u52a1\u7684\u4e49\u52a1\u3002<\/span><\/p>\n<p><span 400;\">\u539f\u544a\u4eba\u968f\u540e\u5411\u9999\u6e2f\u9ad8\u7b49\u6cd5\u9662\u539f\u8bbc\u6cd5\u5ead\uff08\u300c<\/span><b>\u539f\u8bbc\u6cd5\u5ead<\/b><span style=\"font-weight: 400;\">\u300d\uff09\u7533\u8bf7\u767b\u8bb0\u8be5\u5185\u5730\u5224\u51b3\uff0c\u4ee5\u4fbf\u5728\u9999\u6e2f\u6267\u884c\u3002 \u5728\u539f\u8bbc\u6cd5\u5ead\u6279\u51c6\u767b\u8bb0\u8be5\u5185\u5730\u5224\u51b3\u540e\uff0c\u88ab\u544a\u4eba\u5411\u539f\u8bbc\u6cd5\u5ead\u7533\u8bf7\u64a4\u9500\u8be5\u767b\u8bb0\u3002<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span 400;\">2024\u5e742\u670829\u65e5\uff0c\u539f\u8bbc\u6cd5\u5ead\u4f5c\u51fa\u88c1\u5b9a\uff0c\u64a4\u9500\u8be5\u767b\u8bb0\uff0c\u7406\u7531\u4e3a\u8be5\u5185\u5730\u5224\u51b3\u4e2d\u63d0\u5230\u7684\u300c<\/span><i><span style=\"font-weight: 400;\">\u88ab\u6267\u884c\u4eba\u8d1f\u6709\u7ee7\u7eed\u5411\u7533\u8bf7\u6267\u884c\u4eba\u5c65\u884c\u503a\u52a1\u7684\u4e49\u52a1<\/span><\/i><span style=\"font-weight: 400;\">\u300d\u4ec5\u63cf\u8ff0\u4e86\u88ab\u544a\u4eba\u5bf9\u539f\u544a\u4eba\u7684\u5c65\u884c\u8d23\u4efb\uff0c\u5e76\u4e0d\u5177\u5907\u300c<\/span><i><span style=\"font-weight: 400;\">\u8981\u6c42<\/span><\/i><span style=\"font-weight: 400;\">\u300d\u88ab\u544a\u4eba\u652f\u4ed8\u4efb\u4f55\u6b3e\u9879\u7684\u6548\u529b\u3002\u539f\u8bbc\u6cd5\u5ead\u8ba4\u4e3a\u867d\u7136\u8be5\u5185\u5730\u88c1\u51b3\u63cf\u8ff0\u4e86\u88ab\u544a\u4eba\u7684\u4ed8\u6b3e\u4e49\u52a1\uff0c\u4f46\u5e76\u4e0d\u6784\u6210\u65e7\u5236\u5ea6\u4e2d\u7b2c5(2)(e) \u6761\u7684\u89c4\u5b9a\uff0c\u5373\u8be5\u5224\u51b3\u5fc5\u987b\u300c<\/span><i><span style=\"font-weight: 400;\">\u996c\u4ee4\u7f34\u4ed8\u4e00\u7b14\u6b3e\u9879<\/span><\/i><span 2025\u5e745\u670821\u65e5\uff0c\u9999\u6e2f\u9ad8\u7b49\u6cd5\u9662\u4e0a\u8bc9\u6cd5\u5ead\uff08\u300c<\/span><b>\u4e0a\u8bc9\u6cd5\u5ead<\/b><span style=\"font-weight: 400;\">\u300d\uff09\u9a73\u56de\u4e86\u4e0a\u8bc9\uff0c\u7ef4\u6301\u539f\u5224\u3002<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u4e0a\u8bc9\u6cd5\u5ead\u540c\u610f\u539f\u8bbc\u6cd5\u5ead\u88c1\u5b9a\u8be5\u5185\u5730\u5224\u51b3\u5e76\u4e0d\u7b26\u5408\u65e7\u5236\u5ea6\u7b2c5(2)(e) \u6761\u3002 \u5c31\u5185\u5730\u5224\u51b3\u800c\u8a00\uff0c\u6240\u6d89\u503a\u52a1\u4e43\u7531\u5317\u4eac\u957f\u5b89\u516c\u8bc1\u5904\u6839\u636e\u516c\u8bc1\u503a\u6743\u6587\u4e66\u4f5c\u51fa\u88c1\u5b9a\u3002\u5317\u4eac\u6cd5\u9662\u5728\u8be5\u5185\u5730\u5224\u51b3\u4e2d\u7684\u88c1\u5b9a\u4ec5\u9488\u5bf9\u516c\u8bc1\u503a\u6743\u6587\u4e66\u4e2d\u6240\u8f7d\u503a\u52a1\u7684\u6267\u884c\u7a0b\u5e8f\uff0c\u5e76\u6ca1\u6709\u5bf9\u6807\u7684\u503a\u52a1\u989d\u672c\u8eab\u4f5c\u51fa\u88c1\u5b9a; \u800c\u8be5\u5185\u5730\u5224\u51b3\u4e2d\u63d0\u5230\u7684\u300c<\/span><i><span style=\"font-weight: 400;\">\u88ab\u6267\u884c\u4eba\u8d1f\u6709\u7ee7\u7eed\u5411\u7533\u8bf7\u6267\u884c\u4eba\u5c65\u884c\u503a\u52a1\u7684\u4e49\u52a1<\/span><\/i><span style=\"font-weight: 400;\">\u300d\u4ec5\u5c5e\u63cf\u8ff0\u6027\u8d28\uff0c\u5e76\u4e0d\u662f\u76f4\u63a5\u547d\u4ee4\u88ab\u6267\u884c\u4eba\u652f\u4ed8\u6b3e\u9879\u3002
