Litigation, Arbitration & Dispute Resolution
Dispute Resolution ( Litigation & Arbitration )
In today’s complex business environment, disputes are not merely legal challenges, they are critical events that can impact strategy, reputation, and financial stability. Our Dispute Resolution practice aims to navigate these complexities with precision and foresight. We act for listed companies, private companies, overseas corporations, mainland companies, financial institutions, and high-net-worth individuals in high-stakes and complex disputes before the Hong Kong Courts and major arbitral institutions.
Recognising that our clients value their commercial relationships and reputations, we are resolutely focused on strategy and efficiency. We take a pragmatic, solutions-driven approach, exploring mediation and other forms of dispute resolution where they serve the client’s best interests. However, when confrontation is unavoidable, our clients benefit from a team of tenacious and experienced litigators prepared to protect their rights and support them at every stage of the dispute.
Arbitration
International Arbitration
Situated at the heart of Asia and as the gateway to Mainland China, Hong Kong’s unique status under “One Country, Two System” preserves its common law tradition, making it the region’s premier arbitration seat. We regularly represent clients in complex, high-value arbitrations administered under the HKIAC, ICC, SIAC, and UNCITRAL Rules. Our practitioners possess extensive experience managing intricate cross-border disputes, particularly those involving multiple parties and multi-jurisdiction. We are adept at navigating the procedural complexities that arise in such multi-polar disputes, from jurisdictional challenges and consolidation of proceedings to the management of complex evidentiary issues. Our capabilities extend to seeking and resisting urgent interim relief from the Hong Kong courts and ensuring the finality of the process through the strategic enforcement and challenge or setting aside of the awards.
China-Related Arbitration
With the unique advantage of our proximity to, and deep understanding of, the mainland market, we are exceptionally well-placed to handle cross-border disputes with a China nexus. We guide clients through arbitration seated in Hong Kong that involve Chinese parties or assets. We are skilled at bridging the gap between international arbitration practices and the nuances of the Chinese legal system, including managing the recognition and enforcement of arbitral awards in and out of Mainland China, handling applications for interim measures from both the Hong Kong and Mainland Chinese courts (including the unique mechanism for Hong Kong-seated arbitrations to seek asset preservation orders from the Mainland courts), and navigating the procedural and cultural complexities inherent in China-related disputes.
Litigation
Our litigation practice is defined by our ability to handle complex, multi-faceted disputes in all levels of court in Hong Kong. We combine an uncompromising eye for detail with a deep understanding of the commercial realities driving the dispute. With a strong track record of success in the courts, we possess the litigation firepower to see complex cases through to trial while remaining agile enough to secure favourable settlements when commercially advantageous. We act as a true partner to our clients, navigating them through the complexities of legal proceedings with clear advice and a relentless focus on achieving their commercial objective. In parallel, our team is adept at handling white collar crime matters, representing client in regulatory investigation and defending prosecution with the same tenacity and discretion.
